Amendments to the Broadcasting Act come into force

On 7 January 2016, the Act of 30 December 2015 amending the Broadcasting Act was published in the Journal of Laws. The Act does not provide for vacatio legis, and the new regulations come into force on 8 January 2016, i.e. the day after the announcement in the Journal of Laws, and shall become ineffective on 30 June 2016.

The amendments to the Broadcasting Act transfer the right to appoint and dismiss the management and supervisory boards of public broadcasting entities to the sole competence of the Minister of the Treasury.

The regulations repeal the mandatory competition procedures, in which, in the case of members of supervisory boards, the collegiate bodies of academic institutions retained the right to submit candidates.

The amendments also remove the bodies' term limits and repeal the mandatory grounds for dismissal of members of the management and supervisory boards.

On the date the Act enters into force, the terms shall be shortened and mandates shall expire for the current members of the Management and Supervisory Boards of Telewizja Polska and Polskie Radio.

On 30 December 2015, the National Broadcasting Council issued a declaration concerning the changes in the regulations.
